You may use the App for personal communication and language development, educational purposes, supporting speech/language development alongside therapy, creating custom vocabulary, and sharing decks with family/caregivers.
You may not use the App for illegal activities, harassment or harmful communication, reselling or redistributing the App, reverse engineering, circumventing security features, automated account creation, or violating laws.
The following terms apply to our Cloud AI services available in Pro and Premium tiers:
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES.
We are not liable for indirect or consequential damages, inaccurate AI suggestions, communication failures, data loss, third-party service failures, or unauthorized device access.
Our total liability is limited to the amount you paid in the last 12 months (or $50, whichever is greater).
ChirpBot is designed with children's privacy in mind and complies with COPPA:
By setting up ChirpBot for a child under 13, parents certify that you have read these Terms and Privacy Policy, you consent to email collection, you consent to cloud AI processing (if Pro/Premium), and you will supervise your child's use.
This End User License Agreement ("EULA") is between you and ChirpBot AAC only, and not with Apple Inc., Google LLC, or any other platform provider. ChirpBot AAC, not the platform providers, is solely responsible for the App and its content.
ChirpBot AAC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any devices that you own or control, subject to the usage rules set forth in the applicable platform's terms of service (Apple Media Services Terms and Conditions for iOS, or Google Play Terms of Service for Android). You may also access the App through Family Sharing or equivalent features where available.
ChirpBot AAC is solely responsible for providing any maintenance and support services for the App, as specified in this EULA or as required under applicable law. Apple, Google, and other platform providers have no obligation whatsoever to furnish any maintenance and support services with respect to the App.
ChirpBot AAC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify the applicable platform provider, and they may refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, the platform providers will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be ChirpBot AAC's sole responsibility.
ChirpBot AAC, not Apple, Google, or other platform providers, is responsible for addressing any claims you or any third party may have relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ChirpBot AAC, not Apple, Google, or other platform providers, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App. For example, if you use a VoIP application, you must not be in violation of their wireless data service agreement when using the App.
Apple Inc. and Google LLC, and their subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
